Wills...everyone should have one!

“My parents were so proud of what they had built together. What were they thinking? This could have been avoided if they had planned ahead!”

A Last Will and Testament is the very minimum of Estate Plans that every individual should have drawn up, regardless of estate size or family situation.

Only an attorney can legally draft a Will for a person, unless a person drafts his own will. Personally drafted wills are often incomplete or improperly prepared, and therefore may be invalid under state law. An invalid Will is worthless.

Let The Kearse Law Firm, P.C., help put your mind at ease by making sure your wishes are honored regarding beneficiaries, estate and property, and issues that may arise during your lifetime and after your death.

  • Choose those who will inherit your property after your death.
  • Determine who will be the Guardian of your minor children.
  • Control the choice of who will be the Executor of your Estate, the person responsible for distributing your property.
  • State your choices for medical care in the event that you become incapacitated.

If you die intestate (without a Will), by default the laws of your state will determine who will receive your property. These laws vary from state to state, and the rules of distribution may not reflect your own wishes. The controlling legislation represents a guess as to how most people would dispose of their property after their death, but unless you are “most people,” you should be the one making these determinations, not the state. A Will allows you to make your personal preferences binding.   Read More

Every person's circumstances are unique, and a "cookie cutter" approach to creating a will can easily miss the tailored legal solutions you can only get from experienced professionals such as at Kearse & Associates, P.C.
